1. Seller Information
These Terms of Service govern access to and use of the website https://www.artekcraft.com and all purchases made through the Website.

Throughout these Terms, "Artekcraft", "we", "us" and "our" refer to Artekcraft Ltd.
2. Scope
These Terms apply to all visitors, users and customers of the Website.
Any conflicting customer terms shall not apply unless expressly accepted in writing.
3. Eligibility
Customers must be at least 18 years old, possess legal capacity to enter into binding contracts and provide complete and accurate information.
Artekcraft reserves the right to refuse service, limit quantities, suspend accounts or cancel orders at its sole discretion.
4. Products
Products offered may include personalized gifts, laser engraved products, acrylic products, vinyl decals, tumblers and mugs, wooden products, home décor, 3D printed products and accessories.
Due to the handmade and made-to-order nature of many products, minor differences in dimensions, engraving depth, colors, textures, wood grain, transparency and finish shall not constitute defects.
Product photographs, mockups and renderings are illustrative and may differ slightly from the final product.
5. Personalization
Customers are solely responsible for names, dates, initials, uploaded photographs, logos, text, spelling, symbols and instructions.
Products are manufactured exactly according to the information provided.
Artekcraft is not responsible for spelling mistakes, inaccurate information, low-quality uploaded images or customer errors.
Customers are advised to carefully review all personalization information before placing an order.
6. Customer Content
Customers warrant that all submitted materials belong to them or are used with proper authorization.
Customers agree that uploaded logos, photographs, names, trademarks, text and artwork do not infringe the rights of third parties.
Customers agree to indemnify and hold Artekcraft harmless against claims, losses, damages and legal expenses arising from customer-provided content.
Artekcraft reserves the right to refuse unlawful, offensive or infringing requests.
7. Order Acceptance
Submission of an order does not constitute acceptance.
A contract is formed only after payment has been authorized and Artekcraft accepts the order.
Artekcraft reserves the right to reject orders, cancel orders, request additional information or refuse service.
8. Prices and Taxes
Prices displayed on the Website include applicable VAT where required.
Prices may change without notice.
The applicable price is the one shown at checkout.
Customers outside the European Union are responsible for customs duties, import taxes and governmental charges.
9. Payment
Payments are processed through secure third-party payment providers.
Accepted payment methods may include myPOS, debit cards, credit cards, digital wallets and other payment methods shown during checkout.
Artekcraft does not store complete payment card information.
Failed payment authorization may result in cancellation of the order.
10. Production Times
Production times are estimates only.
Artekcraft shall not be liable for delays caused by suppliers, carriers, customs authorities, technical failures, strikes or force majeure events.
11. Shipping
Delivery times are estimates and are not guaranteed.
Customers are responsible for providing correct shipping information.
Additional costs resulting from incorrect addresses, refused deliveries, returned packages or failure to collect parcels shall be borne by the customer.
Packages returned because of customer fault may be reshipped only after payment of additional shipping charges.
12. Right of Withdrawal
Consumers generally enjoy a 14-day right of withdrawal under Directive 2011/83/EU.
However, pursuant to Article 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalized.
Therefore, personalized and custom-made products are non-returnable and non-refundable except where the product is defective, the wrong item was supplied, the product was damaged during transport or the error was caused by Artekcraft.
13. Cancellation Policy
Orders may only be cancelled before production begins.
Once engraving, printing, cutting, manufacturing or personalization has commenced, cancellation is no longer possible.
14. Defective Products
Customers should inspect products promptly after delivery.
Defects must be reported without undue delay.
Artekcraft reserves the right to replace the product, repair the product or issue a refund where legally required.
Normal wear, misuse, improper installation, accidental damage and modifications by the customer are excluded.
15. Legal Guarantee
Nothing in these Terms limits mandatory consumer rights under European Union or national law.
Consumers retain all statutory rights regarding non-conforming goods.
16. Product Variations
Minor differences in dimensions, engraving depth, material texture, wood grain, colors, finish and acrylic transparency are natural characteristics and shall not be considered defects.
17. Color Disclaimer
Actual colors may vary because of display settings, lighting conditions, materials and manufacturing methods.
Such differences shall not constitute defects.
18. Intellectual Property
All content of the Website, including designs, logos, photographs, descriptions, graphics, text and layout, is protected by intellectual property laws.
No content may be copied, reproduced, distributed or used without prior written consent.
19. Refusal of Orders
Artekcraft reserves the right to reject any order containing offensive material, hate speech, illegal content, infringing material, copyrighted content without authorization or trademarks belonging to third parties.
20. Safety
Products are intended for decorative and personal use.
Unless expressly stated otherwise, products are not toys, medical devices or protective equipment.
Customers are responsible for proper installation and use.
Artekcraft shall not be liable for damage arising from misuse, improper installation or modifications made by the customer.
21. Limitation of Liability
To the maximum extent permitted by law, Artekcraft shall not be liable for indirect damages, consequential damages, loss of profits, business interruption, loss of goodwill, emotional distress or loss of opportunities.
Artekcraft's total liability shall not exceed the amount paid for the affected order.
Nothing in these Terms excludes liability that cannot legally be excluded.
22. Force Majeure
Artekcraft shall not be liable for delays or failures caused by wars, pandemics, cyberattacks, governmental actions, natural disasters, transportation interruptions, strikes, supplier failures or power outages.
Performance obligations shall be suspended for the duration of such events.
23. Third-Party Services
The Website may use services provided by Shopify, myPOS, Meta, Google, shipping carriers and analytics providers.
Artekcraft shall not be liable for interruptions caused by third-party providers.
24. Privacy
Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR), applicable Bulgarian legislation and the Website's Privacy Policy.
25. Online Dispute Resolution
Consumers may use the European Commission Online Dispute Resolution platform:

26. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
27. No Waiver
Failure by Artekcraft to enforce any right or provision shall not constitute a waiver.
28. Entire Agreement
These Terms constitute the entire agreement between Artekcraft and the customer and supersede all prior communications, representations and understandings.
29. Amendments
Artekcraft reserves the right to modify these Terms at any time.
Updated versions become effective immediately upon publication on the Website.
30. Governing Law
These Terms are governed by the laws of the Republic of Bulgaria and applicable European Union legislation.
Consumers retain the mandatory protections granted by the laws of their country of residence.
31. Jurisdiction
To the extent permitted by law, disputes shall be subject to the jurisdiction of the competent courts of the Republic of Bulgaria.
Mandatory consumer rights under EU law remain unaffected.
